1. Acceptance of Terms
By accessing or using the ZARIN Real Estate website at zarinrealestate.com, our advisory services, or any related communication channel, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our services.
These Terms form a binding agreement between you ("User", "Client", or "you") and ZARIN Real Estate ("ZARIN", "we", "our", or "us"), a UAE-licensed real estate brokerage operating under RERA regulation. They apply to all interactions — website visits, consultation requests, property viewings, and transactions.
We may update these Terms from time to time. The "Last reviewed" date at the top of this page reflects the most recent revision. Continued use of our services after a change constitutes acceptance of the updated Terms.
2. Description of Services
ZARIN provides real estate advisory, brokerage, and transaction support services in Dubai, UAE. Our services include but are not limited to:
- ·Property search & advisory: identifying properties for sale or off-plan launch that match your stated mandate, area preferences, and budget.
- ·Transaction support: arranging viewings, negotiating offers, preparing contracts, and coordinating escrow and title transfer.
- ·Mortgage & visa advisory: coordinating with banks for mortgage pre-approval and facilitating Golden Visa / investor visa applications.
- ·Property management: post-handover services including tenant sourcing, maintenance oversight, and yield optimization.
- ·Market research & insights: reports, calculators, and analysis published on our website or shared privately with clients.
The website itself, including property listings, calculators, and market content, is provided for informational purposes. It is not a substitute for personalized advice, which we provide only through direct consultation.
3. Eligibility
You must be at least 18 years old to use our services. By engaging ZARIN, you represent and warrant that you have the legal capacity to enter into binding agreements and that the information you provide to us is accurate and complete.
For transaction-level services, you must satisfy UAE AML/KYC requirements — including identity verification, source-of-funds disclosure, and any additional documentation requested by us, the developer, or the relevant UAE regulatory authority. Failure to comply may result in termination of services without refund of any advisory retainer.
4. User Obligations
When using our services, you agree to:
- ·Provide accurate, current, and complete information in all consultations and forms.
- ·Cooperate with reasonable KYC, AML, and source-of-funds verification requests.
- ·Not use our services for any unlawful purpose, including money laundering, sanctions evasion, or fraud.
- ·Not attempt to disrupt, hack, or reverse-engineer our website, tools, or systems.
- ·Respect intellectual property rights — do not copy, republish, or redistribute our content without written permission.
- ·Treat our advisors and staff with courtesy and respect. Abusive or threatening behavior will result in immediate termination of services.
5. Fees & Commissions
Our fee structure is transparent and disclosed before any engagement. The typical structure is:
- ·Buyer-side commission: 2% of property purchase price, payable at title transfer. This is the standard UAE RERA-aligned commission.
- ·Seller-side commission: 2% of sale price, payable at title transfer.
- ·Tenancy agreements: 5% of annual rent for residential, 7% for commercial, payable by tenant per UAE market practice.
- ·Mortgage & visa coordination: included at no extra charge for clients transacting through ZARIN; standalone services are quoted separately.
- ·Initial consultation: free, no obligation.
All commissions are subject to 5% UAE VAT. We issue tax-compliant invoices for every transaction. No hidden fees, no surprise charges — if a fee applies, we disclose it before you commit.
6. Property Listings & Accuracy
Property listings on our website — including photographs, descriptions, pricing, and specifications — are provided in good faith based on information shared by developers, sellers, and third-party data providers. While we make every effort to ensure accuracy, we cannot guarantee that all listing details are complete, current, or error-free at all times.
Prices, availability, and specifications can change without notice, especially for off-plan projects where developer terms evolve. Before any transaction, we verify all material details directly with the developer or seller. We strongly recommend that clients conduct independent legal and technical due diligence on any property before signing a contract.
We are not liable for inaccuracies in third-party listings beyond our control, but we commit to correcting verified errors promptly when brought to our attention.
7. Transactions & Contractual Relationships
When you proceed to a property transaction through ZARIN, separate contractual relationships arise between you and the seller, developer, mortgage lender, escrow agent, and other parties. ZARIN acts as your advisor and broker; we are not a party to the underlying sales contract.
For each transaction, we will guide you through Form A, Form B, Form F, Form I, and Form U as required by RERA. We coordinate with the DLD for Oqood (off-plan) and Title Deed registration. All payments — including deposits, installments, and final balances — are made directly to the developer's escrow account or the seller's designated account, never to ZARIN.
Our advisory fee is invoiced separately and payable upon successful title transfer. If a transaction does not complete for reasons beyond your control (e.g., developer default), no commission is due.
8. Intellectual Property
All content on our website — including text, graphics, logos, photographs, calculators, market reports, and software — is owned by ZARIN Real Estate or our licensors and protected by UAE and international copyright, trademark, and other intellectual property laws.
You may view, download, and print content from our website for your personal, non-commercial use. You may not reproduce, republish, redistribute, or commercially exploit any content without our prior written consent. Brand assets including the ZARIN name, logo, and visual identity are protected trademarks.
If you believe your intellectual property has been used on our website without authorization, please refer to our DMCA / Copyright policy at /legal/dmca.
9. Disclaimer
Information on our website and in our advisory communications is provided for general informational purposes only. It does not constitute legal, tax, financial, or investment advice. Real estate markets carry inherent risks — prices can fall, yields can fluctuate, and individual outcomes depend on factors beyond any advisor's control.
We draw on data from the Dubai Land Department, RERA, developers, and reputable third-party providers. While we believe this data to be reliable, we do not warrant its accuracy or completeness. Past performance is not indicative of future results.
Any opinions expressed in our market reports or blog posts reflect our view at the time of writing and are subject to change without notice. They should not be relied upon as the sole basis for an investment decision.
10. Limitation of Liability
To the maximum extent permitted by UAE law, ZARIN Real Estate shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services. Our aggregate liability for any claim arising from our advisory services is limited to the commission actually paid to us for the specific transaction in question.
We are not liable for: (a) any act or omission by a third party including developers, sellers, lenders, or government authorities; (b) any property defects discovered after purchase; (c) any change in law or regulation that affects your investment; (d) any failure of bank financing or visa approval that is outside our control.
Nothing in these Terms excludes or limits liability that cannot be excluded under UAE law, including liability for fraud, gross negligence, or willful misconduct.
11. Indemnity
You agree to indemnify and hold ZARIN Real Estate, its directors, officers, employees, and partners harmless from any claim, loss, damage, or expense (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any law or third-party right; (c) any inaccurate or misleading information you provided to us; (d) any dispute between you and a property developer, seller, lender, or other transaction party.
We will promptly notify you of any claim for which indemnity is sought and reasonably cooperate in your defense of such claim. You will not settle any claim without our written consent.
12. Termination
Either party may terminate the advisory relationship at any time, with written notice. Upon termination, you remain liable for any commission due on transactions that have already completed or are in advanced stages of execution (e.g., signed Form F).
We may suspend or terminate access to our website immediately, without prior notice, if you breach these Terms, engage in fraudulent or unlawful activity, or pose a risk to our business, clients, or staff.
Survival: Sections 9 (Disclaimer), 10 (Liability), 11 (Indemnity), 13 (Governing Law), and any other provisions that by their nature should survive termination will remain in effect after termination.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates, with specific reference to Federal Laws governing real estate brokerage in the Emirate of Dubai, including the regulations issued by RERA and the Dubai Land Department.
Any dispute arising from or relating to these Terms or our services shall first be addressed through good-faith negotiation. If unresolved within 60 days, the dispute shall be referred to mediation administered by the Dubai Mediation Centre. If mediation fails, the dispute shall be finally resolved by arbitration administered by the Dubai International Arbitration Centre (DIAC) under its rules in force at the time, with the seat of arbitration in Dubai and the language of proceedings in English.
Notwithstanding the above, ZARIN may seek interim or injunctive relief from any competent court to protect its intellectual property, confidential information, or other proprietary rights.
